Long-Term Technology Loan Agreement - Terms & Conditions

 

By accepting possession of the equipment listed above from Texas A&M University-Central Texas, the student understands and agrees to the following terms and conditions: 

  1. Throughout the agreement, the student shall safeguard and use the equipment in accordance with all applicable Texas A&M University-Central Texas (A&M-Central Texas), Texas A&M University System, State of Texas, and federal rules, regulations, policies and laws.   

  1. This equipment shall be used for academic purposes only and must be used by the actively enrolled student. Non-student minors shall not be permitted to use the equipment. 

  1. International travel poses security risks to research data stored on computers and exposes the equipment to theft or confiscation from immigration officials. For the reason, technology cannot be taken out of the United States.  

  1. The equipment will not allow for the installation of any additional software by the student. Any attempt to add, remove, or modify the software on the equipment will constitute forfeiture of eligibility to participate in the Long-Term Technology Loan Program.  

  1. The laptop may be used only for legal, authorized purposes. Unauthorized or illegal uses include but are not limited to: harassment; viewing pornography; destruction of or damage to equipment, software, or data belonging to others; unauthorized copying of copyrighted materials; and private business unrelated to University activities. Borrowers must never engage in any activity that might be harmful to systems or to any information stored thereon, such as creating or propagating viruses, disrupting services, or damaging files, or making unauthorized changes to hardware or software. 

  1. The University reserves the right to recall the equipment at any time. The student agrees to return the equipment to authorized personnel at A&M-Central Texas University Library & Archives on or before the specified due date and/or within 48 hours following a request by A&M-Central Texas representatives. There will be periodic requests to bring the equipment in for maintenance or produce a photograph of the equipment for our annual inventory.  

  1. The student is financially responsible for the replacement cost of the equipment if there is loss, theft, damage, misuse, or abuse. All damage must be reported to the A&M-Central Texas University Library & Archives. Issued equipment can only be serviced by authorized A&M-Central Texas IT personnel. Any attempt to service the equipment by unauthorized parties may result in billable damages to the student. The student understands that any incidents of loss or theft must be reported to the A&M-Central Texas Police Department, your local police department (i.e. Killeen Police Department), AND the A&M-Central Texas University Library & Archives as soon as possible, but no later than 48 hours after the incident. Further, the student understands that lost equipment may not be replaced with other loaned equipment.  

  1. It is the student's responsibility to give a written notice to the A&M-Central Texas University Library & Archives of any change in his/her status as an A&M-Central Texas student in good standing, as well as any address or phone number changes during the period of this agreement or until the equipment is returned to the A&M-Central Texas University Library & Archives.  

  1. A student who withdraws from the University, who is not using the equipment for educational purposes, or who fails to abide by any of the terms of this agreement, agrees to surrender the equipment upon notification and is subject to lose any rights to continue participation in any loaner programs.  

  1. The student understands that the equipment is the property of A&M-Central Texas. In addition to a fine of $10/day, a HOLD will be placed on the student's account which will prevent the student from registering if the student fails to return the equipment by the agreed return date and/or within 48 hours after a request.  Continual refusal or neglect to return the equipment may result in the student being subject to university disciplinary action. 

  1. A&M-Central Texas is not responsible for loss of data stored on the equipment. It is strongly encouraged that students maintain/back up all of their university-related data utilizing their online university-provided Office 365/OneDrive account.  

  1. The student is liable for anything unlawful found on this equipment and may be subject to university disciplinary action. 

A&M-Central Texas hereby disclaims all expressed and implied warranties, including, without limitation, the implied warranties relating to the equipment merchantability and fitness for a particular use. The borrower agrees to accept the equipment "as is." In no event shall A&M-Central Texas or the program representatives be liable for any incidental, special, indirect or consequential damage of whatever nature arising out of any claim alleging A&M-Central Texas’s failure to perform its duty.
